Quick answer: Ask for two papers from property dealers in Gurgaon before you make a token payment: an HRERA agent registration certificate and a dealer licence from the Deputy Commissioner. Verify the agent number online yourself, and note that Haryana’s property dealers’ rules allow 0.5% from the buyer and 0.5% from the seller, plus 18% GST. If a property dealer doesn’t want to put this in writing or cannot provide a RERA number, don’t proceed.
What property dealers in Gurgaon must have?
Most buyers know that projects must be registered with HRERA. Fewer know that property dealers in Gurgaon need registration too, and in Haryana there are two separate papers.
| HRERA agent registration | Haryana property dealer licence | |
| Law | Section 9 of the Real Estate (Regulation and Development) Act, 2016 | Haryana Regulation of Property Dealers and Consultants Act, 2008 |
| Issued by | Haryana Real Estate Regulatory Authority (Gurugram bench for this district) | Deputy Commissioner of the district |
| Covers | Selling or booking units in RERA-registered projects | All dealer work, including resale, rentals, and commission deals |
| What you see | A number in the format RC/HARERA/GGM/…, plus a certificate | A licence copy from the DC’s office |
The two are linked. HRERA Gurugram asks for a copy of the dealer licence when an agent applies for RERA registration (TaxGuru, 2021). So, property dealers in Gurgaon who show a valid RERA number should also be able to show the licence.
In January 2026, HRERA put out an advisory telling buyers to deal only with registered agents. It defined an agent as anyone who negotiates deals, introduces buyers and sellers, or acts for someone else in return for commission. That includes the friend-of-a-friend who “knows the builder”.
How to check property dealers in Gurgaon on the HRERA website
- Ask for the dealer’s RERA registration number in writing. On visiting cards, ads, and WhatsApp messages, it should be printed in full.
- Open haryanarera.gov.in and go to the agent search section. Filter by district (Gurugram).
- Search by the agent’s name or registration number, and open the certificate PDF.
- Match the name, firm, and address on the certificate to the person in front of you. A company’s registration doesn’t cover a freelancer who only says he works with them.
- Note the validity date on the certificate. An expired registration counts as no registration.
Then do the same check on the project. A registered agent selling an unregistered project is still breaking Section 10 of the RERA Act, which bars agents from facilitating such sales.
Under Section 62 of the Act, property dealers in Gurgaon who work without registration or break Section 10 can be fined ₹10,000 for each day the default continues, up to 5% of the cost of the unit sold.
How much brokerage can property dealers in Gurgaon charge?
Rule 10 of the Haryana Regulation of Property Dealers and Consultants Rules, 2009 sets the commission at 0.5% of the agreed deal value from each side, 1% in total. In October 2020, after complaints that some brokers were taking 5–10%, HRERA Gurugram told promoters and brokers on registered projects to stay within it. In September 2022, it warned all 1,840 agents then registered with it that charging arbitrary brokerage would lead to cancellation and blacklisting (Constrofacilitator, 3 September 2022).
Brokers’ associations said in 2020 that they would challenge the cap in court. We could not find a report of any court setting it aside, so ask your dealer to confirm in writing which rate they will charge.
Here is what property dealers in Gurgaon usually charge, by type of deal.
| Type of deal | Who usually pays the dealer | What to expect |
| Resale flat, plot or shop | Buyer and seller, separately | 0.5% of the deal value each under Rule 10, plus 18% GST |
| New launch from a developer | The developer | Developers pay the broker a commission; in 2024, Gurugram developers were reported paying 7–8% to clear stock (Financial Express, via The Realty Today). Ask the dealer to confirm in writing that you owe nothing. |
| Renting a flat | Usually both tenant and owner | Negotiated. Answers on NoBroker’s user forum put it at about 15 days’ to one month’s rent. Agree on the amount before the first site visit. |
GST is charged at 18% on the commission, not on the property price. Property dealers in Gurgaon whose yearly commission income is above ₹20 lakh must be GST-registered and should give you a tax invoice with their GSTIN.
Here is the sum on a resale flat bought for ₹1.2 crore. The dealer’s fee from you is 0.5%, or ₹60,000. GST at 18% adds ₹10,800, so you pay ₹70,800. The seller pays the same again on their side.
Red flags when dealing with property dealers in Gurgaon
- No RERA number on the ad, card, or WhatsApp profile, or a number that doesn’t match the name on the HRERA site.
- A project’s RERA number passed off as the agent’s own. Agent numbers on HRERA Gurugram start with RC/HARERA/GGM; a number like GGM/948/680/2025/51 belongs to a project, not a person.
- A RERA number from another state. Registration is state by state, so a UP or Maharashtra agent number does not cover a deal in Gurugram.
- A “verified” badge on a listing portal offered as proof. Portals set their own rules for that label; only the HRERA register shows registration.
- A brokerage demand above 0.5% of the deal value, or a fee “to be decided later”.
- Token money asked in cash, or into a personal account rather than the seller’s or developer’s account.
- “Pre-launch” or “EOI” bookings in a project that has no HRERA registration yet. HRERA has warned brokers against blocking units before registration.
- A promise of “assured” resale profit or a fixed buy-back price.
- Refusal to share the title documents, approved plan, or occupation certificate before you pay.
- Pressure to sign the same day because “another buyer is waiting”.
Dealer, broker, or consultant: is there a difference?
Not in law. Haryana’s 2008 Act and the RERA Act both treat anyone who earns a commission for arranging a property deal as an agent or dealer, whatever they call themselves. Property dealers in Gurgaon, real estate agents in Gurgaon, real estate brokers in Gurgaon, consultants and “advisers” all need the same registration and follow the same brokerage rules. The useful difference is in the work: some firms only show listings, while others check titles, compare collector rates, and handle registration. Ask what is included before you agree to a fee.
Developers are a separate category. DLF, Godrej, or M3M are promoters who build and register projects; they are not property dealers in Gurgaon, even when “top agents” lists online put them side by side.
How to choose among real estate companies in Gurgaon

There is no official ranking of real estate companies in Gurgaon, so any “best dealer” list is someone’s opinion or an advert. Judge property dealers in Gurgaon on things you can check:
- A valid HRERA agent number and a Deputy Commissioner licence.
- A fixed office address that matches the address on its Google Business Profile.
- A written brokerage agreement that states the percentage and when it is due.
- Local knowledge you can test. For example, a dealer working on Dwarka Expressway should know the HRERA completion dates of projects in Sectors 102–104 without looking them up.
- Reviews that mention specific deals rather than one-line praise.
If you are looking at property dealers in Dwarka Expressway sectors, ask for recent deals in the same society you are considering, not just the same road.
Should you buy through a dealer or straight from the builder?
For a new launch, going direct and going through a registered agent usually costs you the same, because the developer pays the commission. A good agent earns that by comparing projects and checking the HRERA record. For resale, property dealers in Gurgaon are often the only practical way to find sellers. The 0.5% fee is worth paying only if the dealer also checks the title, the society’s no-dues certificate, and the collector rate that sets your stamp duty. The collector-rate step is covered in our registration charges in Gurgaon post.
Frequently asked questions
How do I check whether property dealers in Gurgaon are RERA registered?
Ask for the registration number, then search it in the agent section of haryanarera.gov.in, filtered to Gurugram. Open the certificate and check that the name, firm, and validity date match.
Is RERA registration mandatory for property dealers in Haryana?
Yes, for anyone selling or booking units in a RERA-registered project. Section 9 of the RERA Act requires it, and HRERA repeated the point in a January 2026 advisory.
Does a dealer need a licence as well as RERA registration?
Yes. The Haryana Regulation of Property Dealers and Consultants Act, 2008 requires a licence from the Deputy Commissioner, and HRERA Gurugram asks for a copy of it when an agent applies for RERA registration.
What is the maximum brokerage allowed in Haryana?
1% of the deal value in total, split equally between buyer and seller. The limit sits in Haryana’s property dealer rules of 2009, not in the RERA Act, which is why HRERA cites those rules when it acts against brokers.
Who pays brokerage, the buyer or the seller?
On a resale, each side pays its own share to the dealer. On a new launch bought from a developer, the developer normally pays the broker, so get that confirmed in writing.
How much brokerage is charged on rent in Gurgaon?
There is no fixed figure in law for rentals; the Rule 10 limit is written around the agreed value of a sale. Settle the amount, and whether the owner pays too, before the dealer starts showing flats.
Is GST charged on brokerage?
Yes, 18% on the commission that property dealers in Gurgaon charge, not on the price of the home. Ask for a tax invoice so the payment is on record.
What happens if I deal with an unregistered agent?
You lose an easy route to complain to HRERA, and HRERA has said such transactions may not be recognised under the Act. The agent can also be fined ₹10,000 a day under Section 62.
Is a “verified dealer” badge on a property website the same as RERA registration?
No. Each portal decides what its own badge means. Registration is shown only on the HRERA register, so look up property dealers in Gurgaon there even if a site calls them verified.
Can I complain to HRERA about a property dealer?
Yes. HRERA Gurugram hears complaints against registered agents, and it has said it will cancel and blacklist agents who charge arbitrary brokerage. Keep the agent’s number, invoices, and messages.
Should I use a dealer to buy a resale flat?
Most resale sellers in Gurugram list through property dealers in Gurgaon, so it is hard to avoid one. Agree the fee and the checks the dealer will do in a single written note.
Before you pay a token
